Privacy Protection Policy

1. Purpose


To standardize various personal information processing activities of Demag Plastics Machinery (Ningbo) Co., Ltd. (hereinafter referred to as “Demag” or “we”/“us” ) and its group companies and strengthen the protection of personal information, this privacy statement is hereby formulated according to relevant laws and regulations. This privacy statement (hereinafter referred to as the “Privacy Statement”) aims to introduce how we collect and use your personal information in our business and how you exercise your privacy rights.  


Being clearly aware of the importance of personal information, we will spare no efforts in ensuring the security and reliability of your personal information. To protect all personal information, we strictly abide by the following principles: the principle of consistency between power and responsibility, the principle of clear purpose, the principle of informed consent, the principle of minimum necessity, the principle of ensuring security, the principle of subject participation, and the principle of openness and transparency. Meanwhile, Demag undertakes to adopt corresponding security protection measures to protect personal information according to industry-proven security standards.      


Please carefully read and understand the Privacy Statement before using our products or services.


2. Scope of application


The Privacy Statement applies to the following personal information:


(1) Your personal information collected by us when you visit and use our website https://www.demagplasticsgroup.cn/ (hereinafter referred to as the “Website”); (2) your personal information collected by us when you inquire about, purchase or use our products and/or services; (3) your personal information collected by us when you interact with us through E-mail or other online/offline channels; and (4) your personal information obtained by us from other legitimate sources.  


Our Website may contain a link to any third-party website. Relevant products or services of such third-party websites are not subject to the Privacy Statement. When visiting the aforesaid third-party websites, you are supposed to consult their privacy statements to understand their actual protection of personal information. 


3. Definition of terms


1) The term “personal information” refers to various information recorded through electronic or any other means that can identify the identity or activity of a certain natural person independently or in combination with other information.   


2) The term “personal information subject” refers to the natural person identified by corresponding personal information.


3) The term “personal information processor” refers to organizations or individuals that can determine at their discretion the processing purpose and method of personal information in personal information processing activities.


4) The term “consent” may be defined as follows:


a) Express consent


A personal information subject actively makes a paper or electronic statement in writing or orally, or independently makes any affirmative action (*1) to expressly authorize any particular processing of his/her personal information. (*1) The aforesaid affirmative actions include active ticking, active clicking such buttons as “Agree”, “Register”, “Send” or “Dial”, or active filling or provision of relevant information by the personal information subject.      


b) Authorized consent


A personal information subject expressly authorizes any particular processing of his/her personal information (*1).


*1)The aforesaid authorization includes authorization enabled through active action (i.e., express consent) or through passive inaction (for example, a personal information subject in the information collection area fails to leave the area after being informed of the information collection action).


4. Our business


The products and services provided by Demag mainly include a variety of auxiliary production equipment such as plastic molding machines and injection molding machines. Headquartered in Germany, Demag Group has a number of branch institutions worldwide. In China, our products and services are sold to relevant users generally through our employees and distributors.

5. Processing of personal information


5.1. Purposes for collection and use of personal information


Your personal information collected by us is mainly divided into the following categories:


We may ask you to voluntarily submit personal information. For example, when you submit an inquiry request to us, we may ask you to provide such personal information as your name, contact number, fax and mailbox, and may provide you with our product information, company information, service information and other information about Demag by sending you product catalogue, information about new products, or relevant books, magazines or electronic magazines.  


To facilitate the daily business communication and contract negotiation, execution and performance between us and our business partners and customers, we may collect personal information of our business partners and customers, including name, contact address, contact number, mailbox, address, mobile phone, fax, etc.   


To facilitate our provision of after-sale services and support, we may collect the personal information of customers inquiring of us by phone, including name, contact address, contact number, mailbox, address, mobile phone, fax, etc.


When asking you to provide personal information, we will expressly inform you of the category and purpose of such information. If you fail to submit corresponding personal information as required by us, you may be unable to complete certain matters such as inquiring of us.   


5.2. How we use Cookie


A cookie is a small text file that we store on your computer or mobile device when you visit the Website. Cookies may record information about your visit activity, such as your preferred language, IP address, device model, browser model, general address information (country or city information, etc.) and how your device interacts with the Website. The purpose of using cookies is to facilitate statistics and analysis of visits to the Website or to provide you with improved services. 1) Entrusted processing


To meet the needs of business functions, we may entrust our group companies and third-party partners (such as service providers supporting the normal operation and security of the Website, partners supporting us in after-sale services, and service providers providing us with information system) to process your personal information. 


For companies, organizations and individuals entrusted by us to process personal information, we will sign relevant contracts with them, and ask them to process personal information according to our requirements, the Privacy Statement and other relevant confidentiality and security measures. 


2) Sharing


Without your express consent, we will not share your personal information with any other company other than Demag. 


We may share your personal information externally according to the provisions of relevant laws and regulations or the mandatory requirements of the competent government department(s).


3) Transfer


We will not transfer your personal information to any company, organization or individual, unless under any of the following circumstances:


a)Transfer with your express consent: We will transfer your personal information to any other party after obtaining your express consent;


b) In case of merger, acquisition or bankruptcy liquidation, if it is necessary to transfer your personal information, we will ask the company(ies) or organization(s) serving as transferee of your personal information to be subject to the Privacy Statement, otherwise we will ask such company(ies) or organization(s) to apply for your authorization and consent again.  


4) Public disclosure


We will publicly disclose your personal information only under any of the following circumstances: 


a) We have obtained your express consent;


b) Law-based disclosure: We may publicly disclose your personal information if mandatorily required by any law, legal proceeding, lawsuit or competent government department. 


5.4. Storage of personal information


Storage location: We will store your personal information in servers within China according to relevant requirements of Chinese laws and regulations. If it is necessary to transfer some of the information abroad for any purpose specified in the Privacy Statement, we will obtain your prior consent.


Storage period: Unless otherwise stipulated by laws and regulations, the storage period of your personal information will be as follows:


1) We will keep storing the personal information we collect from you as long as such storage is required to meet our legitimate business needs (such as providing services to you or meeting corresponding legal, tax and financial requirements).


2) When it is no longer necessary for us to use your personal information to meet our legitimate business needs, or when the storage period stipulated by Chinese laws and regulations expires, we will delete or anonymize your personal information.


6. How we protect your personal information


1) We have adopted industry-proven security measures to protect your personal information against unauthorized access, public disclosure, illegitimate use, modification, damage or loss. We will take all reasonably practicable measures to protect your personal information.


2) Our data security capability: We adopt encryption technology to protect data security during data transmission, and install anti-virus software and malware prevention software on devices where personal information is stored. Meanwhile, we will authenticate visitors and grant them the minimum authority before they access to any personal information. Moreover, we will keep all access logs and review them regularly.


3) We will adopt all reasonably practicable steps to ensure that no irrelevant personal information is collected. We will retain your personal information only for the minimum period necessary to achieve the purposes stated in the Privacy Statement unless it is required to extend the retention period or is permitted by law.


4) The Internet environment is not 100% secure and we will do the utmost to ensure the security of the information you provide to us. In the event of any personal information security incident, we will, according to the requirements of laws and regulations, promptly inform you of the nature and possible consequences of the security incident, the actions we have taken and will take, and the suggestions and remedial measures available for you to independently prevent and reduce risks. We will timely inform you of relevant information about the incident by email, letter, telephone, push notification, etc. When it is difficult to inform personal information subjects one by one, we will announce relevant information in a reasonable and effective manner. Meanwhile, we will report to relevant competent departments according to applicable laws and regulations.


7. Your rights


We will, according to relevant laws, regulations and standards of China, ensure your exercising the following rights with respect to your personal information


7.1. Access to your personal information


You have the right to access to your personal information, except for exceptions stipulated by laws and regulations. If you intend to exercise your data access right, you may contact us as specified in “11. Window for inquiry about personal information protection”.


We will reply to your access request within 30 days.


7.2. Correction of your personal information


When identifying any error in your personal information processed by us, you have the right to ask us to make a correction. You may request for correction in the manner described in “7.1. Access to your personal information”.


We will reply to your correction request within 30 days.


7.3. Deletion of your personal information


You may request for deletion of your personal information under any of the following circumstances:  


1) Our processing of your personal information violates any law or regulation; 


2) We collect and use your personal information without your consent;


3) Our processing of your personal information violates our agreement with you;


4) You no longer use our products or services;


5) We no longer provide you with products or services.


If we decide to respond to your request for deletion, we will also notify the entities that have obtained your personal information from us to delete such information in a timely manner, unless otherwise stipulated by relevant laws or regulations or these entities have obtained your independent authorization.


When you delete information from our services, we may not immediately delete corresponding information from the backup system, but we will delete such information in times of backup updating.


7.4. Change of the scope of your authorized consent


The realization of each business function requires some basic personal information. For the collection and use of additionally collected personal information, you may give or withdraw your consent at any time.


You may change your authorized consent by contacting us through the “11. Window for inquiry about personal information protection”.


When you withdraw your consent, we will no longer process the corresponding personal information. However, your decision to withdraw your consent will not affect the processing of personal information previously conducted on the basis of your authorization.


7.5. Account cancellation by personal information subject


You may cancel your previously registered account at any time by contacting us through the “11. Window for inquiry about personal information protection”.


Upon receipt of your request for account cancellation, we will complete relevant verification and processing within 15 workdays if manual processing is required.


After account cancellation, we will stop providing you with products or services, and delete your personal information as required by you, unless otherwise stipulated by laws and regulations.


7.6. Acquisition of personal information copy by personal information subject 


You have the right to obtain a copy of your personal information, for which you may contact us through the “11. Window for inquiry about personal information protection”.


7.7. Response to your request above


For the purpose of security, you may need to provide a written request or otherwise prove your identity. We may ask you to verify your identity before processing your request.


We will reply to your request within 30 days. If you are unsatisfied with our processing of your request, you may contact us through the “11. Window for inquiry about personal information protection”.


For your reasonable request, we will not charge fees in principle, but for repeated requests that exceed reasonable limits, we will charge a certain cost fee as the case may be. We may reject requests that are unnecessarily repetitive, require excessive technical efforts (such as requiring the development of any new system or any fundamental change to existing practice), pose a risk to the legitimate interests of others, or are highly impractical (such as involving information stored on backup tape).


We may fail to respond to a request under any of the following circumstances:


1) The request is related to the performance of obligations stipulated by relevant laws and regulations by the personal information processor;


2) The request is directly related to national security and national defense security; 


3) The request is directly related to public security, public health and major public interests; 


4) The request is directly related to criminal investigation, prosecution, trial and judgment enforcement;


5) The personal information processor can fully prove that the personal information subject has subjective malice or abuse of rights;


6) Responding to the request may help protect the life, property and other important legitimate rights and interests of the personal information subject or other individuals, but can hardly be approved by the latter;


7) Responding to the request will cause serious damage to the legitimate rights or interests of the personal information subject or any other individual or organization;


8) The request involves any business secret. 


8. How we process the personal information of children


None of our services entails the collection of children’s personal information. 


Although local laws and customs may vary in the definition of children, we treat minors aged below 14 as children.


9. How your personal information is transferred worldwide


In principle, the personal information we collect and generate within the territory of the People’s Republic of China will be stored within the territory of the People’s Republic of China.


We can provide products or services through resources and servers worldwide, which means that, with your authorized consent, your personal information may be transferred to, or accessed from, jurisdictions outside the country/region where you use our products or services.


The aforesaid jurisdictions may have different data protection laws or have no such laws. In case of this, we will ensure that your personal information is adequately and equally protected within the territory of the People’s Republic of China. For example, we may ask for your consent to the cross-border transfer of your personal information or implement security measures such as data deidentification prior to cross-border data transfer.


10. How the Privacy Statement is updated


Our privacy statement may be changed.


We will not reduce your rights under the Privacy Statement without your express consent. We will publish any change we make to the Privacy Statement on this page. We may also provide more prominent notice of significant changes (for example, for some services, we may send a notice by email to explain specific changes to the Privacy Statement).


Significant changes referred to in the Privacy Statement include but are not limited to the following: 


1) Our service mode has significantly changed, including any change in the purpose of processing personal information, the type of personal information processed, the usage mode of personal information, etc.;


2) Our ownership structure or organizational structure has significantly changed, including owner change arising from business adjustment, bankruptcy merger, etc. 


3) The main object(s) to which personal information is shared, transferred or publicly disclosed has/have changed;


4) Your right to participate in the processing of personal information or the way in which such right is exercised has significantly changed; 


5) Our responsible department in charge of the processing of personal information, or our contact information or complaint channel has changed; 


6) The personal information security impact assessment report indicates a high risk. We will also archive the previous version(s) of the Privacy Statement for your review.
